This paragraph constitutes our terms and conditions for which we will supply to you the service/ products listed on our website www.homechogh.com (our website).
Please read these terms and conditions carefully before ordering any service/product from us. Please understand that by ordering from us, you agree to be bound by these terms and conditions.
You should copy or print these terms and conditions for future reference.
1. INFORMATION ABOUT US
1.1 - We, a home cookery service, HOMECHO COOKERY SERVICES LIMITED, are a limited liability company registered in Ghana under The Companies Act 1963, Act 179 . We operate the website www.homechogh.com.
2. SERVICE AVAILABILITY
2.1 - Our Site can be used by people residing both in and outside Ghana, but only deliver services to areas in Ghana (indicated service areas). We do accept orders from individuals outside the indicated service areas meant to be delivered to individuals within serviced areas in Ghana.
3. YOUR CUSTOMER STATUS
By placing an order through our website, you warrant that:
3.1 - You are legally capable of entering into binding contracts; and
3.2 - You are at least 18 years old;
3.3 - For delivery purposes, you are a resident of a serviced area
4. OUR SERVICE CONTRACT WITH YOU
4.1 - After placing an order through our website or by phone, you will receive an e-mail (after providing us with your e-mail address) from us acknowledging that we have received your order (Acknowledgement). Please note that this does not mean that your order has been completed or accepted. You must pay the right amount indicated for the service you have ordered. After full payment is received will we process and deliver your order. All special orders (Special Re-orders of Most Recent Past Meals) are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that your special order has been accepted (Confirmation).
5. DISCOUNT VOUCHERS AND GIFT CARDS
5.1 - We may offer gift cards, discount promotions and other types of vouchers which require to be activated by applying to payment of a service on our website ONLY. Gift cards could be purchased and tranferred to a third party without notification of our staff.
5.2 - A Voucher may only be used once by its holder and may not be copied, reproduced, distributed or published either directly or indirectly in any form or stored in a data retrieval system without our prior written approval.
5.3 - We reserve the right to withdraw or deactivate any Voucher (other than a paid-up gift card) for any reason at any time.
5.4 - Vouchers may only be redeemed through our website and not through any other website or method of communication. To use your Voucher you will be required to enter its unique code at the online checkout and use of such code will be deemed to confirm your agreement to these terms and conditions and any special conditions attached to the Voucher.
6. DELIVERY DAY AND WHEN TO ORDER
6.1 - HomeCho “Delivery Day" is on TUESDAYS! , Our "Delivery Week” begins every Tuesday and runs through till Monday. This means that you can order your meal kits on our website anytime between Tuesday and Monday, and expect your delivery to be on the NEXT Tuesday (7 day gap at the earliest). We are currently working on adding weekend deliveries.
8. OWNERSHIP OF MEAL KITS/ PRESERVATION
8.1 - Ownership of the meal kit(s) will only pass to you when we receive full payment of all sums due in respect of the service, including delivery charges (when applicable).
8.2 - To maintain the freshmess of products after delivery, we recommend that you immediately refrigerate or freeze perishable items.
9. PRICE AND PAYMENT
9.1 - The price of the meal kits (and products) and our delivery charges (if applicable), will be as quoted on our website from time to time, except in cases of obvious error.
9.2 - Product prices include VAT, unless otherwise stated.
9.3 - Product prices and delivery charges, if any, are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a confirmation.
9.4 - Payment for all services and products must be by mobile money (MTN, Tigo, Airtel, Vodafon), credit/debit card (Mastercard, American Express, Discover), Ghana-issued Visa card, GH Link, Express card, ALL powered by Express Pay. We reserve the right to change the payment methods we accept at any time.
10. OUR REFUNDS POLICY
10.1 - If you refuse a Product from us, we will follow-up with you to get details of your refusal. If satisfactory, we will either:
10.1.1 - Replace your product as soon as possible and, in any case, within 30 days of the day you gave notice.
10.1.2 - If circumstances are extreme, we will refund the price of the Product in full, and any applicable delivery charges. 10.2 - We will usually refund any money received from you using the same method originally used by you to pay for your purchase.
11. OUR LIABILITY
11.1 - If we fail to comply with these terms and conditions we shall only be liable to you for, at most, the purchase price of the Products.
11.2 - Nothing in this agreement excludes or limits our liability for any matter for which it would be illegal for us to exclude or attempt to exclude our liability.
12. EVENTS OUTSIDE OUR CONTROL
12.1 - We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations in case of events outside our reasonable control (such as natural disasters, civil commotion, riot, invasion, fire, storm, flood, earthquakes, terrorist attack, disease outbreak, impossibility of use of private or public telecommunication networks, etc).
